This Guest Wi-Fi Policy and Terms of Use agreement has been compiled to align with applicable Canadian statutory standards and federal regulations. This includes the provisions of the Copyright Modernization Act (governing online copyright enforcement and notice requirements), the Personal Information Protection and Electronic Documents Act (PIPEDA, establishing federal standards for data privacy and metadata protection), and applicable Canadian telecommunications regulations governing private network operators and internet access provision.

Welcome to our Guest Wi-Fi Network (the "Service"). By connecting to, accessing, or using this Service, you acknowledge that you have read, understood, and agreed to be bound by these Guest Wi-Fi Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must immediately disconnect from the Service.

1. Scope of Service

Complimentary Access: The Service is a complimentary, non-public amenity provided at our discretion for guests, visitors, and authorized patrons.

• Service Availability: We do not guarantee continuous, uninterrupted, or high-speed access. We reserve the right to limit bandwidth, restrict access times, or terminate the Service at any time without prior notice or liability.

2. Acceptable Use Policy (AUP)

You agree to use the Service strictly for lawful, personal, and non-commercial purposes. You are solely responsible for all activities, transmissions, and content generated through your device while connected.

Prohibited Conduct includes, but is not limited to:

• Copyright Infringement & Illegal Downloads: Downloading, uploading, sharing, or streaming pirated or copyrighted material via peer-to-peer (P2P) file sharing, torrents, or unauthorized distribution platforms in violation of applicable laws (including the Copyright Modernization Act).

• Unlawful Content: Accessing, posting, or transmitting material that is illegal, defamatory, harassing, threatening, abusive, or obscene.

• Cybersecurity Breaches: Engaging in hacking, port scanning, vulnerability probing, packet sniffing, or unauthorized access to other network nodes, systems, or accounts.

• Malware Distribution: Transmitting viruses, trojans, worms, ransomware, or any other malicious software.

• Spam & Network Abuse: Sending unsolicited bulk emails (spam), hosting unauthorized services, or consuming excessive bandwidth that degrades network performance for others.

3. Privacy, Logging, and Monitoring

• No Guarantee of Privacy: You acknowledge that unencrypted wireless communications may be intercepted by third parties. You are responsible for ensuring your device utilizes appropriate security measures, such as personal firewalls and Virtual Private Networks (VPNs).

• Traffic Data Collection: To maintain network security, troubleshoot operational issues, and comply with law enforcement requests, we may collect and log technical metadata, including device MAC addresses, IP addresses, session timestamps, and bandwidth utilization.

• Data Privacy: Any personal information collected through your connection will be processed in accordance with applicable privacy legislation (including PIPEDA).

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, ERROR-FREE, VIRUS-FREE, OR UNINTERRUPTED.

5. Limitation of Liability and Indemnification

• Limitation of Liability: UNDER NO CIRCUMSTANCES SHALL THE NETWORK OWNER, OPERATORS, AFFILIATES, OR INTERNET SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNATIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING DATA LOSS, DEVICE DAMAGE, OR SECURITY BREACHES.

• Indemnification: You agree to defend, indemnify, and hold harmless the network owner, officers, employees, and internet service provider against any claims, losses, liabilities, legal fees, or expenses resulting from your misuse of the Service or violation of these Terms.

6. Access Termination

We reserve the right to block your device’s MAC address, restrict access, or terminate your connection immediately and without notice if we suspect a violation of these Terms or any illegal activity.
